TERMS AND CONDITIONS

General

  1. Information on how to participate, rewards and prizes form part of these Terms and Conditions. Participation in this program is deemed acceptance of these Terms and Conditions.
  2. Participation is only open to Australian residents aged 18 years or over (“Participant”). Employees (and their immediate families) of the Promoter and agencies associated with this program are ineligible to participate. Immediate family means any of the following: spouse, ex-spouse, de-facto spouse, child or step-child (whether natural or by adoption), parent, step-parent, grandparent, step-grandparent, uncle, aunt, niece, nephew, brother, sister, step-brother, step-sister or 1st cousin.
  3. The Program commences 12:00noon AEST on 22 September 2008 and ends at 11:59am AEDST on 01/01/09 (“Program Period”).

Surveys

  1. The Promoter will make various Surveys available via the website located at www.brandleaders.com.au (“Website”) during the Program Period.
  2. In order to register, each new Participant will be required to complete the registration form on the Website and provide personal information including their name, self-nominated password, email address (which later becomes their ‘username’) and other details as prompted. The Participant must then record the Username and Password and use these details to log in to the Website each time before they complete each Survey so that their completion of the Survey can be recorded correctly. Each Participant may only be issued one Username. Participants must not share their Username or Password with another other person or allow any other person to use the Website or complete Surveys using their registered details.
  3. Upon successful completion of a Survey during the Program Period, the Participant will be eligible to earn Points. The number of Points awarded is as follows:

  1. Each Participant must register with a valid email address that has not already been used by another Participant to register. Limit one registration per person. Each Participant may complete each Survey only once.
  2. Participants who have earned 3,000 or more Points may elect to redeem 3,000 Points for an entry into a prize draw. Participants may submit multiple entries into the prize draw at the cost of redeeming 3,000 of their Points for each entry.
     
  3. Participants who wish to redeem their Points for an entry into a draw must visit the Website, log in using their Username and Password and follow the prompts to the “checkout” section prior to the closing date.
     
  4. The draw will take place on 05/01/09 at 12noon AEDST at Anisimoff Legal, Level 4, 448 St Kilda Road, Melbourne VIC 3004. The Promoter reserves the right to draw additional reserve entries and record them in order in case an invalid entry or ineligible Participant is drawn. Drawn winners will be notified by mail. Winner’s names will be published in The Australian on 19/01/09.
     
  5. The first fifty (50) valid entries drawn will each win $500 holiday voucher from Rewards Corp. The voucher can be used towards accommodation at over 200 hotels throughout Australia, New Zealand, the Pacific, Asia and can also be used for cruises. Any ancillary costs associated with redeeming the holiday voucher are not included. Any unused balance of the holiday voucher will not be awarded as cash. Redemption of the holiday voucher is subject to any terms and conditions of the issuer including those specified on the vouchers. The holiday vouchers expire on 5/01/10.
     
  6. The Promoter’s decision in relation to all matters arising under this Program is final and binding, and no correspondence will be entered into.
     
  7. The Promoter reserves the right, at any time, to verify the validity of completed Surveys, Participants (including a Participant’s identity, age and place of residence) and Points, and to disqualify any Participant who submits a Survey that is not in accordance with these Terms and Conditions or who tampers with the specified processes. Failure by the Promoter to enforce any of its rights at any stage does not constitute a waiver of those rights.
     
  8. Incomplete, indecipherable or illegible Surveys or other communications will be deemed invalid.
     
  9. If any prize is unavailable, the Promoter, in its discretion, reserves the right to substitute the prize with a prize to the equal value and/or specification, subject to any written directions from a regulatory authority.
     
  10. Total prize pool value is $25,000.
     
  11. Points, prizes, or any unused portion thereof, are not transferable or exchangeable and cannot be taken as cash, unless otherwise specified.
     
  12. Points cannot be used in conjunction with cash or pooled with another Participant.

    A draw for any unclaimed drawn prizes may take place on at 10:00am AEST on 6/04/09at the same place as the original draw, subject to any directions from a regulatory authority.  Winners’ names will be published in The Australian on 20/04/09.
     
  13. Participants consent to the Promoter using the Participant's name, likeness, image and/or voice in the event they are a winner (including photograph, film and/or recording of the same) in any media for an unlimited period without remuneration for the purpose of promoting this competition (including any outcome), and promoting any products manufactured, distributed and/or supplied by the Promoter.
     
  14. If this program is interfered with in any way or is not capable of being conducted as reasonably anticipated due to any reason beyond the reasonable control of the Promoter, the Promoter reserves the right, in its sole discretion, to the fullest extent permitted by law (a) to disqualify any Participant; or (b) subject to any written directions from a regulatory authority, to modify, suspend, terminate or cancel the program, as appropriate.
     
  15. Any cost associated with accessing the Website is the Participant’s responsibility and is dependent on the Internet service provider used. The use of any automated software or any other mechanical or electronic means that allows a Participant to automatically submit Surveys or other data repeatedly is prohibited and will render all entries submitted by that Participant invalid.
     
  16. Except for any liability that cannot be excluded by law, the Promoter (including its officers, employees and agents) excludes all liability (including negligence), for any personal injury; or any loss or damage (including loss of opportunity); whether direct, indirect, special or consequential, arising in any way out of the program, including, but not limited to, where arising out of the following: (a) any technical difficulties or equipment malfunction (whether or not under the Promoter’s control); (b) any incorrect information made available on the Website or in any other promotional material (c) any theft, unauthorised access or third party interference; (d) any entry or prize claim that is late, lost, altered, damaged or misdirected (whether or not after their receipt by the Promoter) due to any reason beyond the reasonable control of the Promoter; (e) any tax liability incurred by a winner or Participant; or (f) use of a prize.
     
  17. As a condition of accepting a prize, the winners must sign any legal documentation as and in the form required by the Promoter in its absolute discretion, including but not limited to a legal release and indemnity form.
     
  18. The Promoter collects personal information in order both to conduct the program and to augment its marketing database which can be used by reputable organisations for direct marketing (including offers sent out via post, email, or communicated by phone) and research purposes. The Promoter may disclose such information to third parties, including, but not limited to, prize suppliers, to reputable organisations accessing the Promoter’s marketing database and to Australian regulatory authorities. Participation is conditional on providing this information. The Promoter and third parties to whom the Promoter provides this information may, for an indefinite period unless otherwise advised, use the information for announcing prize winners (name and suburb/postcode only) and for direct marketing and research purposes.  Participants should direct any request to access, update or correct information to the Promoter.  All entries become the property of the Promoter.  By participating in the program, participants agree to use of their information in accordance with the Promoter’s Privacy Policy, which is accessible at www.brandleaders.com.au.
     
  19. The laws of Australia apply to this program to the exclusion of any other law.  Participants submit to the exclusive jurisdiction of the courts of Australia.
