TERMS AND CONDITIONS

General

1. Information on how to participate, rewards and prizes form part of these Terms and Conditions. Participation in this program is deemed acceptance of these Terms and Conditions.
     
2. Participation is only open to Australian residents aged 18 years or over (“Participant”). Employees (and their immediate families) of the Promoter and agencies associated with this program are ineligible to participate. Immediate family means any of the following: spouse, ex-spouse, de-facto spouse, child or step-child (whether natural or by adoption), parent, step-parent, grandparent, step-grandparent, uncle, aunt, niece, nephew, brother, sister, step-brother, step-sister or 1^st cousin.
    
3. The Program commences 12:00am AEST on 02/05/2008 and ends 5:00pm AEDST on 31/10/2008 (“Program Period”).

Surveys

4. The Promoter will make various Surveys available via the website located at www.brandleaders.com.au (“Website”) during the Program Period.
    
5. In order to register, each new Participant will be required to complete the registration form on the Website and provide personal information including their name, self-nominated password, email address (which later becomes their ‘username’) and other details as prompted. The Participant must then record the Username and Password and use these details to log in to the Website each time before they complete each Survey so that their completion of the Survey can be recorded correctly. Each Participant may only be issued one Username. Participants must not share their Username or Password with another other person or allow any other person to use the Website or complete Surveys using their registered details.
    
6. Upon successful completion of a Survey during the Program Period, the Participant will be eligible to earn Points. The number of Points awarded is as follows:

7. Each Participant must register with a valid email address that has not already been used by another Participant to register. Limit one registration per person. Each Participant may complete each Survey only once.
    
8. Members should only refer friends and family members with whom they have a direct relationship and who consent to receiving information about promotional and marketing activities such as this program. Operation of the “refer a friend” mechanic is subject to the Spam Act 2003 (Cth).

There are two types of prizes ‘Rewards’ and ‘Draws’ which are explained below:

Rewards

9. During the Program Period, there will be three (3) Reward Months as follows:

10. Participants who have earned sufficient Points may elect to redeem their Points for one of the following Rewards:

Notwithstanding the above:

a) The Promoter reserves the right to make an additional Reward(s) available at any time during one (1) Reward Month, as determined by the Promoter in its absolute discretion, in addition to the quantities already available for that Reward Month, and this will be announced via the Website;

b) Any remaining Rewards as at the end of a Reward Month will be added to the quantity of Rewards available for the following Reward Month. 

11. Participants who wish to redeem their Points for a Reward must visit the Website, log in using their Username and Password, follow the prompts to the “checkout” section, and nominate the Reward for which they which to redeem their Points, within a given Reward Month and while that Reward is still available.
     
12. The quantity of each Reward available in each Reward Month is strictly limited to the quantity shown in the above Reward table. Rewards will be allocated in the order claims are received in each Reward Month on a “first come, first served” basis. Once the allocation of a particular Reward in a given Reward Month has been exhausted, that Reward will no longer be available until the beginning of the next Reward Month (if applicable). Final claims for Rewards close 11:59pm AEST 18/07/2008 or when all Rewards have been exhausted, whichever is first to occur.
     
13. Successful claimants will be notified in writing.
     
14. Once a Participant has successfully claimed a Reward, the relevant number of Points will be deducted from their tally.

Draws

15. Participants who have earned 5,000 or more Points may elect to redeem 5,000 Points for an entry into the major prize draw (one prize of $10,000 to be won). Participants may submit multiple entries into the major prize draw at the cost of redeeming 5,000 of their Points for each entry.
     
16. Participants who complete ten surveys will automatically receive one entry into the major prize draw.
     
17. Participants who refer a friend will automatically receive one entry into the major prize draw, for every referred friend they refer who subsequently joins www.brandleaders.com.au, during the Program Period.
     
18. Participants who have earned 3,000 or more Points may elect to redeem 3,000 Points for an entry into any of the monthly prize draws (April to June). Participants may submit multiple entries into any of these draws at the cost of redeeming 3,000 of their Points for each entry.
     
19. Participants who have earned 3,000 or more Points may alternatively elect to redeem 3,000 of their Points for an entry into any of the Resort Rewards draws (May to October).
     
20. Participants who wish to redeem their Points for an entry into a draw must visit the Website, log in using their Username and Password, follow the prompts to the “checkout” section, and nominate the draw that they would like to enter, prior to the closing date for that draw.
     
21. Entries into each draw will not be entered into any other draws.
     
22. The closing time and dates and draw time and dates for each draw are as follows:

23. All draws will take place at Anisimoff Legal, Level 4, 448 St Kilda Road, Melbourne VIC 3004. The Promoter reserves the right to draw additional reserve entries and record them in order in case an invalid entry or ineligible Participant is drawn.
     
24. Winners will be notified by mail. Winner’s names will be published in The Australian on the dates specified in the table above.
     
25. The first five (5) valid entries drawn in each of draws 1, 2 and 4 will each win the relevant prize set out below. The first fifty (50) valid entries drawn in each of draws 3 and draws 5 – 9 will each will win the relevant prize, as set out below. The first one (1) valid entry drawn in draw 10 will win the $10,000 cash prize, as set out in the table below.

26. For the Major Prize Draw, there will be one (1) prize. The first valid entry drawn will win $10,000 cash. The prize will be awarded in the form of a cheque made payable to the winner.

General

27. The Promoter’s decision in relation to all matters arising under this Program is final and binding, and no correspondence will be entered into.
     
28. The Promoter reserves the right, at any time, to verify the validity of completed Surveys, Participants (including a Participant’s identity, age and place of residence) and Points, and to disqualify any Participant who submits a Survey or claim that is not in accordance with these Terms and Conditions or who tampers with the specified processes. Failure by the Promoter to enforce any of its rights at any stage does not constitute a waiver of those rights.
     
29. Incomplete, indecipherable or illegible Surveys, claims or other communications will be deemed invalid.
     
30. Rewards and prizes are subject to the standard terms and conditions of individual prize and service providers.
     
31. Membership of the Presidential Card programme is subject to the terms and conditions of that programme.
     
32. Redemption of the movie passes, the music vouchers and the resort vouchers are subject to any terms and conditions of the issuer including those specified on the passes/vouchers. Movie passes are adult single passes redeemable for Monday–Thursday sessions only and cannot be redeemed for “no free list” sessions. Movie passes cannot be redeemed for seats at La Premiere theatres.
     
33. Any ancillary costs associated with redeeming the voucher prizes are not included. Any unused balance of the vouchers will not be awarded as cash. Redemption of the vouchers is subject to any terms and conditions of the issuer including those specified on the vouchers.
     
34. The winners of the Resort Reward vouchers are subject to the conditions specified above in clauses 32 & 33 and the conditions specified on the reverse of the voucher. Travel for Resort Reward vouchers must be redeemed booked by 30 December 2008, for travel by 30 June 2009.
     
35. If any Reward or prize (or part of any Reward or prize) is unavailable, the Promoter, in its discretion, reserves the right to substitute the Reward/prize (or that part of the Reward/prize) with a Reward/prize to the equal value and/or specification, subject to any written directions from a regulatory authority.
     
36. Total value of all Rewards is $76,500.00. Total value of all drawn prizes (including Monthly Prize and Major Prize Draws $173,735.00. Total pool value including all Rewards and drawn prizes is $250,235.00.
     
37. Points, Rewards, prizes, or any unused portion thereof, are not transferable or exchangeable and cannot be taken as cash, unless otherwise specified.
     
38. Points cannot be used in conjunction with cash or pooled with another Participant.
     
39. Any unclaimed Rewards as at the end of the promotional period shall be forfeited.
     
40. In the event that the winner of a Resort Reward Voucher (excluding SA winners) cannot be contacted by 1/12/08 the Promoter shall conduct an unclaimed prize draw at 10am AEST at the same place as the original draw on 3/12/08 in order to award the prize. The names of any winners will be published in The Australian on 8/12/08.
     
41. In the event that a South Australian drawn winner of a Resort Reward Voucher comes forward after 1/12/08 but before 12/02/09, they will be awarded an alternative prize to an equal or greater value, as determined by the Promoter in its absolute discretion.
     
42. A draw for any unclaimed drawn prizes, including Resort Reward Voucher prizes where the original drawn winner was a South Australian resident, may take place on at 10:00am AEST on 12/02/09 at the same place as the original draw, subject to any directions from a regulatory authority. In the event that any Resort Reward Vouchers have remained unclaimed, the winner drawn in the unclaimed prize draw shall receive an alternative prize to equal or greater value, as determined by the Promoter in its absolute discretion. Winners’ names will be published in The Australian on 17/02/09.
     
43. Participants consent to the Promoter using the Participant's name, likeness, image and/or voice in the event they are a winner (including photograph, film and/or recording of the same) in any media for an unlimited period without remuneration for the purpose of promoting this competition (including any outcome), and promoting any products manufactured, distributed and/or supplied by the Promoter.
     
44. If this program is interfered with in any way or is not capable of being conducted as reasonably anticipated due to any reason beyond the reasonable control of the Promoter, the Promoter reserves the right, in its sole discretion, to the fullest extent permitted by law (a) to disqualify any Participant; or (b) subject to any written directions from a regulatory authority, to modify, suspend, terminate or cancel the program, as appropriate.
     
45. Any cost associated with accessing the Website is the Participant’s responsibility and is dependent on the Internet service provider used. The use of any automated software or any other mechanical or electronic means that allows a Participant to automatically submit Surveys or other data repeatedly is prohibited and will render all entries submitted by that Participant invalid.
     
46. Except for any liability that cannot be excluded by law, the Promoter (including its officers, employees and agents) excludes all liability (including negligence), for any personal injury; or any loss or damage (including loss of opportunity); whether direct, indirect, special or consequential, arising in any way out of the program, including, but not limited to, where arising out of the following: (a) any technical difficulties or equipment malfunction (whether or not under the Promoter’s control); (b) any incorrect information made available on the Website or in any other promotional material (c) any theft, unauthorised access or third party interference; (d) any entry, Reward claim or prize claim that is late, lost, altered, damaged or misdirected (whether or not after their receipt by the Promoter) due to any reason beyond the reasonable control of the Promoter; (e) any variation in Reward or prize values to those stated in these Terms and Conditions; (f) any tax liability incurred by a winner or Participant; or (g) use of a Reward or prize.
     
47. As a condition of accepting any Reward or prize, the winners must sign any legal documentation as and in the form required by the Promoter in its absolute discretion, including but not limited to a legal release and indemnity form.
     
48. The Promoter collects personal information in order both to conduct the program and to augment its marketing database which can be used by reputable organisations for direct marketing (including offers sent out via post, email, or communicated by phone) and research purposes. The Promoter may disclose such information to third parties, including, but not limited to, reward and prize suppliers, to reputable organisations accessing the Promoter’s marketing database and to Australian regulatory authorities. Participation is conditional on providing this information. The Promoter and third parties to whom the Promoter provides this information may, for an indefinite period unless otherwise advised, use the information for announcing prize winners (name and suburb/postcode only) and for direct marketing and research purposes. Participants should direct any request to access, update or correct information to the Promoter. All entries become the property of the Promoter. By participating in the program, participants agree to use of their information in accordance with the Promoter’s Privacy Policy, which is accessible at www.brandleaders.com.au
     
49. The laws of Australia apply to this program to the exclusion of any other law. Participants submit to the exclusive jurisdiction of the courts of Australia.
     
50. The Promoter is Pacific Micromarketing Pty Ltd (ABN 89 053 912 502) of Level 11, 2 Southbank Blvd, Southbank VIC 3006.
